Registration of a built house
Build a house - this is still half the battle. In order to fully own and dispose of them at its discretion, it is necessary to go through the procedure of registering this house. Registration of buildings on your site is in accordance with Art. 25.3 of Law No. 122-FZ of July 21, 1997, as amended and the simplified procedure specified in the law on dacha amnesty No. 93-FZ.
Prepare a package of documents for the branch of Rosregistratsiya confirming your right to a land plot. In addition to the passport, you will need a certificate of ownership, an act of granting land or an extract from the business book.
2). Do not forget to attach the cadastral passport to your land plot. It is better to arrange it in advance, because this procedure is long (up to 1 month). To get it, you must submit to the district office of Rosnedvizhimost a document confirming your right to land, on the basis of which the cadastral passport for the site will be issued.
3). Now you will need to draw up documents that confirm the presence of the house on the site. If the house was built a long time ago and the old-fashioned registration certificate was issued for it, it will be enough. If you do not have any documentation for the house, first of all you should contact the BTI for a cadastral passport for the house. There you make a request for measurements and documentation of the structure by the staff of the BTI, this service is paid.
four). With the permission of the local administration to enter such an individual housing construction object (individual housing construction) into operation or, if the house is still unfinished, a construction permit, these documents are also desirable to attach. When registering for the dacha amnesty program, these documents are not required, however, if registration takes place in the general procedure, they will not be able to do without them.
five). By submitting all the above documents to the Rosregistratsia office, you will receive an application form for registration of ownership and a declaration of immovable property. When filling out these documents, you will need to specify the area of the house to be registered, the cadastral number of the plot where the house is located, the address, the number of floors (if there is a basement), the material of the outer walls, whether the house is connected to engineering communications.
6). After checking the documentation at a specified time, you will be given a certificate of ownership of the house. If for any reason you were denied Rosregistratsia, write a statement of claim on recognition of ownership of the house to the court, attach copies of all the above documents. In the case of a positive court decision, the registering authority will issue a certificate of ownership of your home.
Registration of ownership of a built house is an integral part of the process of registration. Only after passing through all instances, having completed all procedures properly, you will acquire the legal right to dispose and possession of the house in the form of a certificate of ownership and will be able to sell, donate or leave the next generations.See also:
